A Black attorney in the New Jersey Department of Banking and Insurance failed to prove he was subjected to a racially hostile work environment but can still keep the $986,000 a jury awarded him because the evidence backed his retaliation claim, a state appeals court ruled.
A new trial on damages is ordinarily required when a jury verdict is reversed, the New jersey Appellate Division said. But the verdict sheet in Nathan Johnson’s case asked the jury to award him a lump sum in emotional distress damages if it found he was subjected to harassment “and/or” retaliation, the court said. ...
